Australia's federal and state cultural heritage protection legislation presents unique challenges to developers and business.
We understand these challenges, including the permit requirements. And, in the case of Aboriginal cultural heritage, it can require pre-construction archaeological assessments, and the appointment of monitors during construction works.
Our team of more than 15 environmental lawyers has significant expertise and experience in advising clients on strategies to challenge or oppose the proposed heritage listing of properties, buildings and assets, and on developing heritage listed assets.
Experience
Some of our recent experience includes:
- Sheoak Flat wind farm – We advise Pacific Hydro on its cultural heritage agreement with the Narungga Nations for the Sheoak Flat wind farm in South Australia.
- Aboriginal heritage legislation – Advised a timber plantation company on the operation of new Aboriginal heritage legislation in Victoria, and on compliance plans and strategies.
- Murraylinkand Bas link interconnector – We have advised the developers of the Basslink and Murraylink interconnectors on Victorian, Tasmanian, South Australian and Commonwealth Aboriginal cultural heritage legislation.
- Ord Stage 2 Project, Western Australia – Adviser to the Water Corporation of Western Australia in relation to aboriginal heritage and native title matters, land acquisition issues and general contractual issues.
- Raffles redevelopment – Adviser to the developer with respect to planning approvals and heritage issues for the Raffles redevelopment.
- Perth Entertainment Centre redevelopment – Adviser to tendering, planning and heritage issues for the proposed redevelopment of the Perth Entertainment Centre and surrounding precinct.
- Lutton Refinery – Advised Caltex in relation to planning, cultural heritage and environmental approvals required for the Lytton Refinery upgrade.
- Games Village – Advised the Office of Commonwealth Games Coordination on the planning and heritage aspects of the Games Village in Parkville, including drafting the planning and heritage protection controls for the residential development.
- Millmerran Power project – Advised InterGen Australia Pty Ltd with respect to the development of Cultural Heritage Agreements as part of their Millmerran Power project.
- PNG Gas Pipeline – Advised APC on environmental, planning and cultural heritage for the PNG Gas Pipeline project.
