Current practice
Terry joined Freehills on 1 January 1999 as a partner in the funds management practice, focusing on the financial services sector, including superannuation trusts, pension funds and other retirement savings arrangements, investments management, remuneration, tax and life insurance.
Terry regularly advises in the following areas:
- compliance and due diligence reviews covering fund documentation and administration
- regulatory aspects of the development of financial products
- superannuation issues arising out of a sale and purchase of businesses
- SGC and surcharge issues
- structuring or restructuring of superannuation arrangements, including fund mergers and disposal of funds and the taxation implication
- dispute resolution, including advice relating to disputed death and disablement benefits
- life insurance, and
- investment Management Agreements, major custody agreements and related matters.
Experience
Prior to joining Freehills, Terry was senior legal counsel at AMP Financial Services, advising on all aspects of the law relating to both public offer and corporate superannuation funds and life insurance products.
In addition, Terry was involved in the development of new financial products (including a wrap account) and an ACCC submission analysing changing trends and future directions of financial products and finance industry participants.
Previously, he spent a number of years with the Commonwealth Bank involved particularly in strategic planning, and subsequently as a principal and national practice leader of the Legal group at William M Mercer Pty Limited in Sydney. Whilst at Mercers, Terry gained extensive experience in remuneration and wealth accumulation planning, international transfers and the taxation aspects of superannuation funds and benefits.
Terry's client list consisted of large corporate and industry fund clients, including international companies.
Professional background
Terry holds a Bachelor of Arts and Master degrees in Laws and Business Administration.
Among other things, Terry is a Fellow of the Income Tax Association of Australia and a member of the Law Council of Australia Superannuation Committee, the ATO Superannuation Lawyers Consultative Committee and the International Pensions and Employee Benefits Lawyers Association (IPEBLA). In addition, he is a regular speaker at superannuation law conferences, and contributor to industry publications.
